Terms of Use — Market Tolk

1. Acceptance

By accessing or using Market Tolk, operated by 5V LLC, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service. You represent that you are at least 18 years old.

2. What the service is

Market Tolk provides descriptive readings of US financial market conditions — price structure, fundamentals, and macro indicators — in plain language in Portuguese, English, and Spanish. Readings are generated from public data and proprietary models, updated on a fixed schedule, and shown identically to all users.

3. What the service is not

This section is central to the agreement between you and Market Tolk.

Market Tolk is not investment advice, a registered investment adviser, broker-dealer, asset manager, securities analyst, or robo-adviser.

Readings describe conditions; they are not recommendations. We do not tell you to buy, sell, enter, or exit any asset, and we do not opine on whether investing in a specific asset is appropriate.

We do not forecast prices, tops, bottoms, or future market moves, and we do not promise or guarantee returns or performance.

Intrinsic value estimates are model values shown as context. The difference between price and estimated value is an observation, not a buy or sell judgment.

No fiduciary relationship exists between you and Market Tolk. No reading considers your financial situation, objectives, or profile; output is the same for everyone.

In the United States, we operate under the Publisher's Exclusion of the Investment Advisers Act of 1940. In Brazil, we operate as impersonal market information aligned with CVM Resolutions 19 and 20. Nothing here constitutes regulated activity reserved to licensed participants.

You are solely responsible for your investment decisions. We recommend consulting a qualified professional before making decisions.

4. Account and access

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us of unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Plans, payment, and cancellation

We offer a free plan and paid monthly/annual plans charged through Stripe.

Founder pricing is maintained while the subscription remains active and uninterrupted, as described on the plans page.

Subscriptions renew automatically until cancellation. You may cancel at any time; paid access continues until the end of the paid period.

Refunds: 7 calendar days from the subscription/payment date.

6. Acceptable use

You may not resell, redistribute, or create derivative products from the readings without written license; scrape or access data through unauthorized automation; reverse engineer models; or use the platform for unlawful purposes.

7. Intellectual property

The platform, readings, explanatory texts, methodology, brand, and visual elements are owned by 5V LLC and protected by law. We grant you a personal, non-transferable, revocable license to use the service under these Terms. No intellectual property rights are transferred to you.

8. Third-party data

Readings use third-party market data sources, including FMP, Alpaca, and others. We do not guarantee that third-party data is free of errors, delays, or interruptions, and we are not responsible for source failures.

9. Limitation of liability

To the maximum extent permitted by law, the service is provided as is, without warranties of accuracy, completeness, or fitness for a particular purpose. We are not liable for losses, damages, lost profits, or investment decisions made based on readings. Investing involves risk, including total loss of capital. Past results do not guarantee future results.

10. Changes

We may modify or discontinue features and update these Terms. Material changes will be communicated. Continued use after changes means acceptance.
